The 6th Circuit Court of Appeals (covering Tennessee, Kentucky, Ohio and Michigan) previously decided that severance payments aren&#8217;t taxable. <em>See<\/em> <a href=\"http:\/\/www.ca6.uscourts.gov\/opinions.pdf\/12a0313p-06.pdf\"><em>U.S. v. Quality Stores<\/em>, Case No. 10-1563 (6th Cir. 2012)<\/a>.<\/p>\n<p>The Federal Circuit Court of Appeals held that severance payments were taxable. <em>See<\/em> <a href=\"http:\/\/www.cafc.uscourts.gov\/images\/stories\/opinions-orders\/07-5003.pdf\"><em>CSX Corp., et al v. U.S.<\/em>, 518 F.3d 1328 (Fed.
